Revised Pollution Fines


On 28  December 2023 the administrative fines have been revised and published in the Official Gazette. With the new measures for marine pollution the vessels that violate Turkish anti-pollution regulations face harsher penalties as the fines have been raised under article 20 of Environmental Code no:2872.

The related communiqué entered into force as of 01.01.2024 and you may find the revised fines below; 

 

What are the types of pollutants?

1. Petrol and Petroleum Products

(Applies for vessels, other marine vehicles and tankers)


2. Dirty Ballast

(Only applies for vessels, other marine vehicles and tankers)


3. Garbage

(Applies for vessels or any other marine vehicles)


4. Sewage Water

(Applies for vessels or any other marine vehicles)

(i) domestic waste water (sewage),

(ii) water mixed with detergent,

(iii) foam,

(iv) exhaust gas,

(v) washwater

(vi) and similar washing waters and solid wastes

 

FINES PER TONNAGE

A. Petrol and Petroleum Products

Penalties for Tankers

For tankers up to 1000 gross tonnes ["GT"] (including 1000), the penalty fee was previously 2.009,85 TL per GT and now it is 3.184,81 TL per GT. For tankers between 1.000 and 5.000 (inclusive) GT, the penalty fee was previously 502,48 TL per GT and now it is an additional 796,23 TL per GT. For tankers over 5.000 GT, while the penalty fee was previously 50,23 TL per GT, it is now an additional 79.56 TL per GT.

Penalties for Vessels and Other Marine Vessels

For those up to 1000 gross tonnes ["GT"] (including 1000), the penalty fee was previously 1004,92 TL per GT and now it is 1592,40 TL per GT. For those between 1.000 and 5.000 (including 5.000) GT, while the penalty fee was previously 200,99 TL per GT, it is now an additional 318,49 TL per GT. For those over 5.000 GT, while the penalty fee was previously 50,23 TL per GT, it is now an additional 79,59 TL per GT.

B. Dirty ballast

Penalties for Tankers

For tankers up to 1000 gross tonnes ["GT"] (including 1000), the penalty fee was previously 366,18 TL per GT and now it is 580,25 TL per GT. For tankers between 1.000 and 5.000 (including 5000) GT, the penalty fee was previously 73,05 TL per GT and now it is an additional 115,76 TL per GT. For tankers over 5.000 GT, while the penalty fee was previously 11,59 TL per GT, it is now an additional 18,37 TL per GT.

Penalties for Vessels and Other Marine Vessels

For those up to 1000 gross tonnes ["GT"] (including 1000), the penalty fee was previously 1004,92 TL per GT and now it is 1592,40 TL per GT. For those between 1.000 and 5.000 (including 5.000) GT, while the penalty fee was previously 200,99 TL per GT, it is now an additional 318,49 TL per GT. For those over 5.000 GT, while the penalty fee was previously 50,23 TL per GT, it is now an additional 79,59 TL per GT.

C.  Fines for Garbage and Seewage for Vessels and Other Marine Vehicles

For those up to 1000 gross tonnes ["GT"] (including 1000), the penalty fee was previously 502,48 TL per GT and now it is 796,23 TL per GT. For those between 1.000 and 5.000 (including) GT, the penalty fee was previously 100,50 TL per GT and now it is an additional 159,25 TL per GT. For those over 5.000 GT, the penalty fee was previously 11,59 TL per GT, now it is 18,37 TL per GT.

It is important to note that those who repeat the above-mentioned penalties will not only be subject to the above-mentioned penalties, but also to more severe penalties for re-polluting. If the pollution is repeated within 3 years, the penalty will be doubled. If it is repeated for the second and subsequent times, there will be a 200% increase

-Marmara Sea (including all harbours and anchorage areas within Istanbul)

-Kocaeli -Ihlara - Yalova,

-Bursa -Balikesir -Canakkale

-Tekirdag -Fethiye -Gocek,

-Foça -Gökova -Göksu Delta,

-Gölbaşı Datça -Bozburun -Kaş

-Kekova -Belek -Patara

- Salt Lake - Uzungol - Saros Bay

-Pamukkale - Koycegiz-Submarine Mountains

-Salda Lake -Karaburun -Princess Islands

 

  • The above rates are doubled for the pollution incurred at Specially Protected Areas
  • If the vessel cleans the pollution on its own , by using her own means, the admistrative fine is reduced in the amount of 1/3.
  • If the fine is paid within the 30 days of the service date, there is 25% discount.
  • If the owner of the vessel which cause the pollution is a legal entity, the fines are tripled.
  • If any hazardous waste or similar nature or of its substances is the causation for pollution, the fine imposed is 10 times of the annouced amount.
