On 29 December 2022 the administrative fines have been revised and published in the Official Gazette. With the new measures for marine pollution the vessels face harsher penalties as the fines have been raised. Below mentioned rates are valid as of 01.01.2023. There is significant increase of 122.93% in the fines compared with 2022( you may find in our previous information note on the matter through the link at the end) for those vessels that violate Turkish ati-pollution regulations.
What are the types of pollutants?
1. Petrol and Petroleum Products
(Only applies for vessels)
2. Dirty Ballast
(Only applies for vessels)
3. Garbage
(Applies for vessels or any other marine vehicles)
4. Sewage Water
(Applies for vessels or any other marine vehicles)
(i) domestic waste water (sewage),
(ii) water mixed with detergent,
(iii) foam,
(iv) exhaust gas,
(v) washwater
(vi) and similar washing waters and solid wastes
FINES PER TONNAGE
A. Petrol and Petroleum Products
-For vessels up to and including 1,000 gross tons (GT) 2.009,85-Turkish Liras per GT
-For vessels between 1,000 and 5,000 gross tons (GT), an additional 502,48-Turkish Liras per GT in addition to the above-mentioned amount.
-For vessels that are over 5,000 gross tons (GT), an additional 50,23-Turkish Liras per GT in addition the above-mentioned amount.
B. Dirty ballast discharged by tankers
-For vessels up to and including 1,000 gross tons (GT) 366,18-Turkish Liras per GT
-For vessels between 1,000 and 5,000 gross tons (GT) an additional 73,05-Turkish Liras per GT in addition to the above-mentioned amount.
-For vessels that are over 5,000 gross tons (GT) an additional 11,59-Turkish Liras per GT in addition the above-mentioned amount.
C. Petrol/petroleum products and dirty ballast discharged by vessels or any other marine vehicles
-Up to and including 1,000 gross tons (GT), 1.004,92-Turkish Liras per GT
-Between 1,000 and 5,000 gross tons (GT), an additional 200,99-Turkish Liras per GT to the above-mentioned.
-Over 5,000 gross tons (GT), an additional 50,23-Turkish Liras per GT in addition to the abovementioned.
D.Garbage and sewage discharged by vessels or any other marine vehicles:
-Up to and including 18 gross tons (GT), 11.146,00-Turkish Liras per GT
-Between 18 and 50(including) gross tons (GT), 22.293,00-Turkish Liras
-Between 50 and 100(including)gross tons (GT), 44.586,00-Turkish Liras
-Between 100 and 150(including)gross tons (GT), 66.876,00-Turkish Liras
-Between 150 and 1000(including) gross tons (GT), 502,48-Turkish Liras (base)
-Up to 1000 and 5000(including)gross tons (GT) an additional 100,50-Turkish Liras per GT in addition to the abovementioned.
-More than 5000 gross tons (GT) an additional 50,23-Turkish Liras per GT in addition to the abovementioned.
Specially Protected Areas;
-Marmara Sea (including all ports and anchorage areas within Istanbul)
-Kocaeli -Ihlara - Yalova,
-Bursa -Balikesir -Canakkale
-Tekirdag -Fethiye -Göcek,
-Foça -Gökova -Göksu Delta,
- Gölbaşı Datça -Bozburun -Kaş
-Kekova -Belek -Patara
- Tuz Lake - Uzungöl Lake -Saros Gulf
-Pamukkale - Köyceğiz -Deniz Altı Dağları
-Salda Lake -Karaburun -Prince’s Islands
*If the owner of the vessel which cause the pollution is a legal entity, the fines are tripled.
*The above rates are doubled for the pollution incurred at Specially Protected Areas
*If any hazardous waste or similar nature or of its substances is the causation for pollution, the fineimposed is 10 times of the annouced amount.
*If the fine is paid within the 30 days of the service date, there is 25% discount.
*If the vessel cleans the pollution on its own , by using her own means, the admistrative fine isreduced in the amount of 1/3.
