As of 5 April 2023, the "Law on the Amendment of the Execution and Bankruptcy Law and Certain Laws", including new regulations in the judicial system, has been published in the Official Gazette No. 32154 and entered into force. Within the scope of the Law, compulsory mediation process will be applied to the disputes arising from the lease agreements, disagreements regarding the division of movables and real properties and the elimination of joint ownership, disputes arising from the Property Law and disputes arising from the vicinity rights.
As of September 1, 2023, it will no longer be possible to file a lawsuit in disputes arising from the lease agreements without applying to the mediation process. The regulation aims to prevent the caseload arising from disputes over the recently rising rental prices. Applications can be made free of charge to the mediation offices at the Courthouses. In the following process, mediation sessions will be completed within three weeks, and if needed, this period can be extended by one week. In case an agreement cannot be reached as a result of the negotiations, the parties will be able to file a lawsuit.
With the new regulation entering into force, it is expected that approximately 74 thousand disputes arising from the lease relationship will be resolved annually through mediation process.
