MARINE POLLUTION FINES

New amendments to the Environmental Code were published in the Official Gazette on the 15th June 2022. With the new measures for marine pollution the vessels face harsher penalties especially within the Specially Protected Areas (please find below)

What are the types of pollutants?

1. Petrol and Petroleum Products

(Only applies for vessels)

 

2. Dirty Ballast

(Only applies for vessels)

 

3. Garbage

(Applies for vessels or any other marine vehicles)

 

4. Sewage Water

(Applies for vessels or any other marine vehicles)

 

(i) domestic waste water (sewage),

(ii) water mixed with detergent,

(iii) foam,

(iv) exhaust gas,

(v) washwater

(vi) and similar washing waters and solid wastes

 

What are the differences in the new amendment regarding sea pollution fines?

 

  • The fines have been increased by 30.26 percent since the 1st of January 2022
  • The new amendment is clear on the types of discharges that would be considered as pollution.
  • Harsher fines for smaller vessels

Petrol and Petroleum Products

 

-For vessels up to and including 1,000 gross tons (GT)901.56 Turkish Liras per GT

 

-For vessels between 1,000 and 5,000 gross tons (GT), an additional 225.40 Turkish Liras per GT in addition to the above-mentioned amount.

 

-For vessels that are over 5,000 gross tons (GT), an additional 22.53 Turkish Liras per GT in addition the above-mentioned amount.         

 

 Dirty ballast discharged by tankers

-For vessels up to and including 1,000 gross tons (GT) 164.26 Turkish Liras GT

-For vessels between 1,000 and 5,000 gross tons (GT) an additional 32.77 Turkish Liras per GT in addition to the above-mentioned amount.

 

Petrol/petroleum products and dirty ballast discharged by vessels or any other marine vehicles

-Up to and including 1,000 gross tons (GT), 450.78 Turkish Liras per GT

 -Between 1,000 and 5,000 gross tons (GT), an additional 90.16 Turkish Liras per GT to the above-mentioned.

-Over 5,000 gross tons (GT), an additional 22.53 Turkish Liras GT in addition to the above-mentioned.

 

Garbage and sewage discharged by vessels or any other marine vehicles:


-Up to and including 1,000 gross tons (GT), 225 Turkish Liras per GT

-Between 1,000 and 5,000 gross tons (GT), 45.08 Turkish Liras per GT in addition to the above-mentioned amount.

-Over 5,000 gross tons (GT), an additional 22.53 Turkish Liras per GT in addition to the above-mentioned.

-Up to and including 18 gross tons (GT), 5.000 Turkish Liras per GT

-Between 18 and 50(including) gross tons (GT), 10.000 Turkish Liras

-Between 50 and 100(including)gross tons (GT), 20.000 Turkish Liras

Between 100 and 150(including)gross tons (GT), 30.000 Turkish Liras

Between 150 and 1000(including) gross tons (GT), 225 Turkish Liras

Up to 1000 and 5000(including)gross tons (GT), 225.40 Turkish Liras per GT in addition to the above-mentioned and 45.08 Turkish Liras per excessive GT

More than 5000 gross tons (GT) in addition to the above-mentioned, 22.53 Turkish Liras per GT
